DMCA Notice

Desi Footprints respects the intellectual property rights of others and expects our users to do the same. It is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). If you believe that your work has been copied in a way that constitutes copyright infringement, please provide us with the following information:

Filing a DMCA Notice

If you believe that content on our site infringes your copyright, you may submit a DMCA Notice to us with the following details:

  1. Your Contact Information:
    • Your full name, mailing address, phone number, and email address.
  2. Description of the Copyrighted Work:
    • A detailed description of the copyrighted work that you claim has been infringed. If possible, include the URL or location where the original work is published.
  3. Infringing Content:
    • Identify the specific content on Desi Footprints that you believe is infringing your copyright. Please include the URL(s) of the exact web page(s) where the infringing material is located.
  4. Statement of Good Faith:
    • Include a statement that you have a good faith belief that the use of the copyrighted material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of Accuracy:
    • A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Signature:
    • Your physical or electronic signature. This could be your typed name at the end of the email.

Upon receiving a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing content and take reasonable steps to notify the user who posted it.

Counter-Notification

If you believe that the content you posted on Desi Footprints was mistakenly removed or disabled in response to a DMCA notice, you may file a counter-notification. Your counter-notification must include:

  1. Your Contact Information:
    • Your full name, mailing address, phone number, and email address.
  2. Identification of Removed Content:
    • A description of the material that was removed or disabled, including the URL(s) of the affected content.
  3. Statement of Good Faith:
    • A statement, under penalty of perjury, that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.
  4. Consent to Jurisdiction:
    • A statement that you consent to the jurisdiction of the federal court in your district, or if you are outside of the United States, the jurisdiction of the courts where Desi Footprints may be found, and that you will accept service of process from the person who provided the original DMCA notice or their agent.
  5. Signature:
    • Your physical or electronic signature.

Send your counter-notification to the same contact information provided above. Upon receiving a valid counter-notification, we may restore the removed content unless the original complainant files a court action seeking an order to prevent such restoration.

Repeat Infringer Policy

Desi Footprints reserves the right to terminate user accounts that are found to be repeat infringers of copyright.
